Terms of Service

Agreement

By accessing hitback.xyz, using the HitBack VS Code/Cursor extension, or creating an account, you agree to these Terms. If you do not agree, do not use the service.

The service

HitBack connects advertisers who want to reach developers with developers who earn revenue when ads are shown during AI agent wait-states in supported editors. We provide the marketplace, ad delivery, measurement, and payout infrastructure.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. Business users represent that they have authority to bind their organization.

Developer terms

• Installing the extension constitutes consent to display ads during eligible wait-states, subject to rate limits.
• Developers receive a revenue share of ad spend as displayed in the product (currently 60% of gross ad revenue attributable to their impressions).
• Payouts require a connected Stripe account and meeting the minimum withdrawal threshold.
• You may not manipulate impressions, automate fraudulent views, or interfere with measurement systems.

Advertiser terms

• Ad copy and landing URLs must be accurate, lawful, and not misleading. Prohibited content includes malware, illegal goods, hate speech, and deceptive offers.
• Campaigns run on a CPM auction model. Higher bids receive priority in the live queue.
• Impression blocks are prepaid through Stripe. Unused impressions remain on the campaign until delivered or the campaign is exhausted.
• You may pause or resume active campaigns at any time. Paused campaigns do not serve until resumed.
• We reserve the right to reject, pause, or remove campaigns that violate these Terms or harm user trust.

Payments and refunds

All charges are processed by Stripe. Advertiser purchases are generally non-refundable once impressions have begun delivering, except where required by law or at our sole discretion for billing errors. Developer payouts are subject to Stripe's terms and applicable tax reporting requirements.

Intellectual property

HitBack retains all rights in the platform, brand, and software. Advertisers retain rights in their ad content and grant HitBack a license to display it through the service. Developers do not acquire rights in advertiser content by viewing ads.

Disclaimer

The service is provided "as is" without warranties of uninterrupted availability, specific earnings amounts, or click-through performance. Ad delivery depends on developer adoption, queue competition, and technical factors outside our control.

Limitation of liability

To the maximum extent permitted by law, HitBack is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim arising from the service is limited to the greater of $100 or the amounts you paid us in the twelve months before the claim.

Termination

You may stop using HitBack at any time. We may suspend or terminate access for violations of these Terms, fraud, or operational reasons. Provisions that should survive termination (payment obligations, liability limits, dispute terms) will survive.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer protections apply in your jurisdiction.
